Terms of Service & Research Policies

1. Independent Research & Non-Affiliation Disclaimer

TxBidMetrics is an independent private market intelligence provider. TxBidMetrics is not affiliated with, sponsored by, endorsed by, or an agent of the City of Dallas, Dallas Water Utilities (DWU), the Texas Department of Transportation (TxDOT), or any other municipal, county, state, or federal governmental authority.

2. Nature of Data & "As-Is" Public Records

All project briefs, subcontractor schedules (Forms 213/214, 640, 240, 603), bidder rankings, and unit rate tabulations are extracted directly from official municipal public records released by awarding agencies. While TxBidMetrics exercises strict research diligence to parse and verify data integrity:

• Public filings reflect the submissions of third-party bidding contractors and public city clerks at the time of council award.
• Itemized line-item unit rate schedules are included where released in the public record; certain master or task-order contracts may omit unit rates pursuant to public records exemptions.
• All research reports are provided on an "as-is, where-is" basis for commercial benchmarking and estimating reference only.

3. Electronic Delivery & Fulfillment Terms

All TxBidMetrics research products are delivered exclusively in digital electronic format (PDF documents and CSV tables) to the email address provided at checkout:

• In-Stock Research Briefs: Reports on completed audits are verified and delivered electronically via automated email immediately following payment verification.
• On-Demand Custom Audit Requests: Custom research requests are formally filed and tracked through municipal public information portals pursuant to Texas statutory processing schedules. Completed briefs are compiled and delivered immediately upon official records release by the awarding agency.

4. Refund, Cancellation & Statutory Clearing Guarantee

We maintain strict, transparent consumer and corporate refund terms:

• Immediate Statutory Refund Guarantee: If a customer orders an On-Demand Project Audit for a municipal contract that is subsequently determined to be cancelled, un-awarded, rejected by council vote, or formally withheld by the awarding agency under statutory trade secret exemptions (Tex. Gov't Code § 552.110), the customer will receive an immediate 100% refund of the $350.00 fee back to their original payment method.
• Delivered Research: Because TxBidMetrics delivers proprietary, non-tangible public research documents electronically upon payment verification, sales of successfully delivered research briefs are final.
• Subscription Cancellations: Subscribers to the Monthly Intelligence Subscription ($599.00/month) are on a month-to-month agreement. Subscribers may cancel at any time with zero penalties or lock-in through their Stripe Customer Portal or by notifying support@txbidmetrics.com. Cancellation takes effect at the end of the current billing cycle.

5. Commercial Use License & IP Protections

Upon purchase, TxBidMetrics grants the purchasing entity a non-exclusive, non-transferable internal commercial license to use the delivered research brief, unit rate data, and subcontractor intelligence for internal estimating, preconstruction planning, and competitive bidding. Customers may not publicly republish, broadcast, scrape, or resell TxBidMetrics proprietary executive brief documents to third-party commercial databases without express written authorization.

6. Limitation of Liability

TxBidMetrics provides competitive historical intelligence. In no event shall TxBidMetrics, its researchers, or operators be liable for any indirect, consequential, special, or punitive damages arising from the use of its public records research, including but not limited to bid submission outcomes, project losses, or subcontractor performance. In all circumstances, TxBidMetrics' maximum aggregate liability shall not exceed the amount paid by the customer for the specific research brief or applicable monthly subscription fee.

7. Governing Law & Jurisdiction

These Terms of Service and all related transactions are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflicts of law principles. Any legal proceedings arising hereunder shall be instituted exclusively in the state or federal courts located in Dallas County, Texas.
